Register your pool

Did you know that if you are selling your property and haven't registered your pool the purchaser may be able to rescind the contract within 14 days of exchange.

If you are selling or renting out a property with a pool or spa on it you must register it on the NSW Swimming Pool Register. If you haven’t already, it’s easy, do it now here:- http://www.swimmingpoolregister.nsw.gov.au

You also need to obtain a certificate of compliance or a certificate of non compliance or a relevant occupation certificate issued within the last 3 years. If you don’t have any of these the purchaser of the property can opt out of the contract within 14 days after contracts are exchanged. The documents should be attached to the Contract for Sale. If you need someone to inspect your pool and issue a certificate of compliance or non compliance the NSW Government Swimming Pool Register has a list of inspectors here: http://www.swimmingpoolregister.nsw.gov.au/inspection

Purchasers should be aware that if the Seller supplies a Certificate of Non Compliance, the purchaser will have 90 days from the date the contract completes to rectify the defects specified in the Certificate of Non Compliance and obtain a Certificate of Compliance.
